WWE News: 2K & WWE Seek To Have Lawsuit By Randy Orton’s Tattoo Artist Dismissed

With the news today that Titus O’Neil has counter-sued cameraman Donald Anderson all stemming from an incident during filming of the WWE Network show, Swerved (to read about that go here), there’s more news on the legal front surrounding WWE.

If you remember, tattoo artist Catherine Alexander is suing both WWE and 2K over her works for WWE Superstar Randy Orton were used in WWE video games (for that story go here). Orton, who is currently out of action after knee surgery (read about that here), has had work done by Alexander since 2003.

2K filed a response with the court yesterday that stated the lawsuit should be dismissed since Alexander does not actually have any copyright registrations (to which Alexander admits in her lawsuit) on the designs that she states are hers. Additionally, 2K states that Alexander also cannot claim damages retroactively:

“Statutory damages and attorney’s fees are only available where the works were registered before the infringement occurred or within three months of their publication. Accordingly, statutory damages and attorney’s fees are unavailable to Plaintiff as a matter of law”

WWE also filed for dismissal yesterday, however is calling for it on the means that Alexander has failed to prove how the court in Illinois (where the suit was filed) has any jurisdiction over them since their headquarters is in Connecticut, while also being incorporated in Delaware. WWE is claiming that Alexander must provide “specific activities that WWE has supposedly undertaken in Illinois with respect to the claims at issue”.
